Conditions of Sale
All orders are accepted subject to crop failures or damage by natural causes, and we reserve the right to refund all or any part of the payment made. We are careful to keep varieties true to name and will replace any that may be otherwise, upon proper proof, or refund the original purchase price, but not more than the original amount. We give no warranty, express or implied, as to growth or productivity. All orders are accepted without liability for nonperformance if labor shortages or delays in transportation prevent us from making a delivery. The parties hereto agree that any dispute arising out of the sale of these goods shall be arbitrated exclusively in the Chancery Court for Warren County, TN, and the state of Tennessee shall be the forum for any and all litigation that may arise from the sale of goods by the seller. Any party not prevailing in such action shall be liable to the prevailing party for reasonable attorney fees.
Waiver of Implied Warranties
WE ARE NOT RESPONSIBLE UNDER ANY CONDITIONS OF THE LIVABILITY OR MERCHANTABILITY OF PLANTS THAT WE SHIP. Claims for shortages or damaged material should be made within 10 days. We do not assume responsibility for stock damages after acceptance by or in transit by a common carrier. THIS WARRANTY, WHICH IS GIVEN EXPRESSLY AND IN LIEU OF ALL OTHER WARRANTIES EXPRESSED OR IMPLIED OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE CONSTITUTES THE ONLY WARRANTY MADE BY THE SELLER.
Prices and Terms
All prices are wholesale F.O.B. our nursery and subject to change without notice. B&B freight charges must be paid on delivery unless prior arrangements have been made. All bare-root orders will have boxing and shipping charges added at the time of invoicing/shipping which typically averages 20-25% of material cost. We do not break bundles on bareroot so please order accordingly. Established accounts terms are net 30 days from the date of shipment. COD orders require a 50% nonrefundable deposit in advance (balance due on delivery) with a current credit application on file. We reserve the right to require full payment in advance.
ALL CREDIT CARD PAYMENTS WILL HAVE AN ADDITIONAL 3% CONVENIENCE FEE ADDED TO THE TOTAL COST.
FULL PAYMENTS RECEIVED 30 DAYS PRIOR TO THE SHIP DATE ON ORDER CAN RECEIVE A 5% DISCOUNT.

Summer Digging
Summer digging begins April 15th–October 15th. We do not advise digging during this time. We reserve the right to add 15-20% to our listed price if we are required to water plants in the field prior to digging.
